Terms of Service

The short version: you see one total before you order, we hold exactly that on your card, you see a photo before anything is bought, you pay only for what you say yes to, and every piece is final sale unless the shop says otherwise. The details are below.

1. Who we are and what these terms cover

These terms are an agreement between you and Shophr Corporation, a Delaware corporation (“Shophr”, “we”, “us”), 925 N La Brea Ave, Suite 500, Los Angeles, CA 90038. They cover our website, shophr.co, and the orders you place on it. Our Privacy Policy explains what we do with your information.

By creating an account or placing an order, you agree to these terms. If you don’t agree, please don’t use Shophr. The Shophr app and the retailer portal at retailers.shophr.co are run separately and are not covered here.

2. Who can use Shophr

  • You must be 18 or older and able to make a contract.
  • Shophr is invite only for now. You need an invitation code to create an account, and one account is for one person.
  • We deliver in Melrose, Fairfax, La Brea, West Hollywood, Hollywood, Larchmont and Beverly Hills, and to addresses within about five miles of them. If your address is outside that area, we keep your request as a place on our waitlist and tell you when we reach you. Nothing is bought or charged.
  • We may pause new orders at any time, for example while we fix something. While orders are paused you can still browse and fill your bag.

3. Your account

  • Give us true details and keep them up to date, especially your delivery address and phone number.
  • Keep your password to yourself. Tell us straight away at support@shophr.co if you think someone else has used your account.
  • You can close your account at any time by writing to support@shophr.co.

4. How Get it for me works

You pick a piece from a shop near you, and a Shophr shopper, who works for Shophr, goes to the shop, buys it for you and brings it to your door. For these orders we buy the piece from the shop and sell it to you, so Shophr is the seller.

  • Before you order, you see one total, with every part of it listed, and the shop’s return terms as we know them.
  • When you order, we place a hold on your card for exactly that total (section 6). Nothing is charged yet.
  • Your shopper finds the piece and sends you a photo. You answer on your order page: yes, or not quite.
  • If you say yes, we charge your card and your shopper buys the piece and brings it to you.
  • If you say not quite, we leave it in the shop and release your hold. Nothing is charged.
  • If you order several pieces together, you answer for each one, and you pay only for the pieces you say yes to (section 6).

Arrival times we show are our best estimate, not a guarantee. Traffic, the shop and the weather can make an order later.

5. Prices and what you pay

The total you see before you order is made of these parts, and nothing else:

The shop’s own price
What the shop charges for the piece. We never mark it up.
Shophr service fee
For finding it, buying it and checking it: $14 when your shopper buys at a boutique, $19 at a mall or big-box store, and $9 when we only collect something that is already paid for (if an order has more than one kind of shop, the higher fee applies). Plus $4 for each extra piece from a shop already in your order, $12 for each extra shop, and 4% of the pieces’ price above $500, up to $100.
Payment processing, at cost
What our card processor, Square, charges to take the payment. We pass it on at cost and keep none of it. It is not a surcharge, and it is the same whichever card you use.
Delivery
By distance from the shop to your door (the farthest shop, if there is more than one): $9.99 under 3 miles, $14.99 for 3 to 8 miles, $22.99 for 8 to 15 miles. We don’t deliver from shops more than 15 miles away. Your first order gets $3 off delivery.
Sales tax
California sales tax at the rate for your delivery address, on the whole total. We find the rate from your street address using the State of California’s own tax-rate lookup.

The amounts above are today’s. The order screen always shows the amounts for your order, and those are the ones you pay. If we ever charge you more sales tax than was due, we pay the difference back to you.

Prices come from what shops publish, and they can change. If the shop’s price has gone up by the time your shopper gets there, we don’t buy it at the higher price unless you agree to a new total first. If you don’t, we release your hold and you pay nothing. If a price we show is plainly a mistake, we may cancel the order, and nothing is charged.

6. Card holds and payment

  • Cards are taken by Square. Your card details go straight to Square; Shophr never sees or stores your full card number.
  • When you order, we hold exactly the total you were shown on your card. A hold is not a charge. It lasts 24 hours when your piece is bought the day you order, and 96 hours when it is bought on a later day. If nothing is bought by then, the hold ends by itself and nothing is charged.
  • When you say yes to the photo, we charge your card, up to the amount held. We never charge more than the hold.
  • For an order of several pieces, we charge only for the pieces you say yes to, priced as if you had ordered just those, and never more than the hold. If you say yes to none, we release the hold.
  • A released hold can stay on your bank statement for a few days before your bank removes it.

If something is wrong with a charge, please write to support@shophr.co before you dispute it with your bank. We can usually fix it faster.

7. Delivery

  • Give us an accurate address and any door or access notes, and be there, or have someone there, to take it.
  • If nobody is there, your driver waits and tries to reach you. If we still can’t hand it over, the driver takes the piece back with them and we get in touch to arrange another delivery. If that second trip has a delivery fee, we tell you the amount and ask you first. It is never taken from your hold.
  • The piece becomes yours, and your responsibility, when it is handed to you or left where you asked.

8. Cancelling and changing an order

  • You can cancel for free until you say yes to the shopper’s photo: tap Not quite on your order page, or write to support@shophr.co. We release your hold and nothing is charged.
  • Once you say yes, we buy the piece for you, so the order can’t be cancelled. Section 9 covers returns.
  • You can change the delivery address until your driver is on the way to you. Write to support@shophr.co. The new address has to be in our delivery area.

9. Returns, final sale and store credit

Final sale unless the shop says otherwise. We check the shop’s policy before anything is bought. Before you say yes, we show you the shop’s return terms as we know them, or tell you we don’t know them yet, in which case your shopper asks at the register and tells you before we pay.

  • If the shop takes returns, write to support@shophr.co and we’ll tell you how it works, and what it costs, if anything, before anything happens. You get back what the shop gives back.
  • If the shop gives store credit instead of money, we pass that credit on to you. Shophr doesn’t issue store credit of its own.
  • A piece from a shop that sells everything as final sale can only be ordered after you tick a box that says: “I understand this piece is final sale. No returns, exchanges or refunds, from the shop or from Shophr. If what arrives isn't the piece I approved in the photo, Shophr makes it right.

Our own mistakes are ours. If what arrives isn’t the piece you said yes to in the photo (the wrong piece, the wrong size, or damage the photo didn’t show), tell us at support@shophr.co with a photo within 48 hours of delivery. We collect it and refund everything you paid for it, whatever the shop’s policy, final sale included.

Nothing in these terms takes away a right the law gives you.

10. Text messages

Texts aren’t switched on yet. Until they are, every update about your order comes by email. This is how our texting program, Shophr order updates, will work:

  • It is optional. You join only by ticking the box that asks, and texting is never a condition of buying anything. A yes for your account’s own number covers your later orders to that number until you turn texts off in your profile, write to us, or reply STOP.
  • We text the number you gave us about orders you place: the photo to approve, when it’s bought, when it’s on the way, and when it’s here. Up to 4 texts per order. We don’t send marketing texts.
  • Message and data rates may apply.
  • Reply STOP to any of our texts to cancel. Reply HELP for help, or write to support@shophr.co.
  • Carriers are not liable for delayed or undelivered messages.
  • We never sell or share your mobile number or text-message opt-in with third parties for their marketing or promotional purposes (see our Privacy Policy).

The box says, word for word: “Text me about my orders. Shophr will text this number about orders I place: the photo to approve, when it's bought, when it's on the way, and when it's here. Up to 4 texts per order. Msg & data rates may apply. Reply STOP to cancel, HELP for help. Not required to order.

11. The shops on Shophr

The shops you see on Shophr are independent businesses. Unless we say that a shop has signed with us, it has no agreement with Shophr and isn’t affiliated with us: we buy from it the way any customer would, and we don’t give it your name, address or contact details.

We show pieces from what shops publish on their own public websites, so a price, a size, a photo or whether a piece is still there can be out of date. We check in the shop before anything is bought, and you only pay for what you say yes to. When a shop signs with us, its orders may work differently, and we will tell you how before you order.

12. Using Shophr fairly

Please don’t:

  • break the law, or use Shophr for fraud, including false claims about what arrived;
  • sell invitation codes, or make more than one account;
  • harass or threaten our shoppers, drivers, shop staff or team;
  • give false details, or pretend to be someone else;
  • copy or scrape the site, use bots on it, or get around any limit we set;
  • interfere with the site or test its security without our written permission.

We may pause or close an account that breaks these rules. Open orders and refunds are still handled.

13. What you send us

If you send us something, like a message or a photo, it stays yours. You let us use it to handle your order and to run Shophr. We won’t use it in advertising without asking you first.

14. Our name and our site

The Shophr name, logo, site and software belong to Shophr. You may use the site for your own shopping, as these terms allow. Shop names, logos and product photos belong to the shops or their owners. If you think something on Shophr infringes your rights, write to support@shophr.co with the details.

15. Disclaimers

As far as the law allows, the site is provided as it is and as available. We don’t promise it will always be available or free of errors, or that an order will arrive by a particular time. Nothing in these terms limits a warranty or right the law gives you that can’t be waived.

16. Limits on our liability

As far as the law allows:

  • we are not liable for indirect or consequential losses, or for lost profits or data;
  • our total liability to you for all claims about Shophr is limited to the greater of what you paid Shophr in the 12 months before the claim and $100.

These limits don’t apply to death or personal injury caused by our negligence, to fraud, or to anything else the law doesn’t let us limit.

17. If we disagree

Please write to support@shophr.co first, with your name, your order number and what you’d like us to do. We will try to put it right within 30 days.

California law governs these terms. A dispute that goes to court will be heard in the state or federal courts in Los Angeles County, California, unless the law lets you bring it where you live. Either of us may use small claims court.

18. Closing an account

You can stop using Shophr and close your account at any time. We may close an account if it breaks these terms, to protect people or the site, or if the law requires it, and we will tell you why unless we can’t for legal or safety reasons. Open orders and refunds are still handled, and sections 5, 6, 9 and 13 to 17 keep applying.

19. Changes to these terms

We may update these terms. The date at the top always shows the latest version. For a material change, we email you at least 30 days before it takes effect. A change never applies to an order placed before it. If you don’t agree to a change, you can close your account.

20. The rest

  • These terms and our Privacy Policy are the whole agreement between you and Shophr about the site.
  • If part of these terms can’t be enforced, the rest still applies.
  • If we don’t enforce a right straight away, we haven’t given it up.
  • You can’t transfer these terms to someone else. We may transfer them if Shophr is sold or merges.
  • We aren’t responsible for delays caused by things outside our reasonable control.
  • Accessibility: if any part of the site doesn’t work for you, write to support@shophr.co and we’ll help you place your order.

For California residents: under California Civil Code section 1789.3, you can contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by phone at (800) 952-5210.
